Confidentiality Agreement

I have requested that Adero Pty Ltd (ABN 96 624 398 929) (Adero Law) provide further information regarding the administration of the settlement agreement in the matter of Aaron Furnell & Ors v SEPL Pty Ltd (the Class Action).

I understand that Adero Law may not be able to provide me with certain information, including:

information and documents that are subject to confidentiality orders made in the Class Action (accessible at: https://www.comcourts.gov.au/file/Federal/P/SAD76/2020/3889537/event/31268089/document/2041033) (the Confidentiality Orders); and

information that Adero Law is unable to provide me in accordance with its obligations under the Privacy Act 1988 (Cth) (the Privacy Act). This includes information relating to the claims of other group members.

To the extent permitted under the Confidentiality Orders and the Privacy Act, I request that Adero Law provide me with further information regarding the administration of the settlement in the Class Action as it relates to my own claim.

I undertake to keep confidential, and not publish, disclose, or discuss the contents of the documents made available to me by Adero Law in connection with the settlement of in the Class Action to any person or entity other than:

any solicitor of Adero Law acting in the Class Action; or
an Australian Legal Practitioner, for the purposes of seeking and receiving independent legal advice; or
an accountant or financial adviser, for the purposes of seeking taxation advice.

I will not use the documents provided to me by Adero Law for any other purpose other than for considering my rights in the Class Action.

I understand that this undertaking shall not apply in circumstances where I disclose the contents of the documents provided to me:

after I have received written consent of Adero Law; or
as required by law, or as ordered by the Court.
