Front Financial
Adero Law is conducting an investigation into the broker firm Front Financial (WRBS Capital Pty Ltd) for potential negligence and breaches of consumer laws in providing advice and services in relation to unfair and unsuitable loans, and possible unconscionable conduct.
We are aware that some clients may have been recommended loans that were inappropriate for their financial circumstances, unsuitable for their intended purpose, or beyond their capacity to repay. Borrowers or guarantors may have been required to secure these loans against their homes.
Our investigation focuses on whether Front Financial fulfilled its legal obligations as a broker to act in the best interests of clients, provide suitable credit assistance, and make proper inquiries into a client’s objectives, needs, and financial position.
Adero Law is examining whether Front Financial (WRBS Capital Pty Ltd) may have engaged in conduct including:
- recommending loans that were not suitable for a client’s circumstances or objectives;
- failing to properly assess a borrower’s capacity to repay, including ignoring financial stress or over-commitment;
- advising clients to take out loans that were not fit for their stated purpose (e.g., business loans used for personal or mixed purposes);
- arranging loans with high interest rates, hidden fees, or high-risk structures without adequate explanation;
- failing to disclose the risks associated with securing the loan against a home or investment property;
- prioritising the broker’s own commissions or relationships with lenders over the best interests of the borrower;
- engaging in conduct that may amount to unconscionable behaviour, particularly where clients were vulnerable or financially distressed.
If these practices occurred, affected clients may be entitled to compensation or may have grounds to challenge the loan or the broker’s conduct.
